Summary of Experience
Johan has advocacy and litigation experience before the Fair Work Commission, Queensland Industrial Relations Commission, Federal Courts and Human Rights Commissions, including unfair dismissal, general protections, discrimination, bullying, sexual harassment, adverse action, contractual, award, enterprise agreement, underpayment of wages prosecutions and workplace investigation matters. This includes preparing submissions and evidence, providing advocacy, briefing counsel, appearing at conciliation and conference processes and arbitrations, and developing litigation strategies that align legal risk with commercial and workplace realities.
Johan is a seasoned negotiator with extensive experience in enterprise agreement bargaining and industrial relations, including advising on bargaining strategy, acting as an employer bargaining representative, drafting and reviewing agreement terms, managing access period and approval requirements, assessing BOOT risks, responding to employee and union claims, and supporting Fair Work Commission approval processes.
Johan is skilled in handling industrial disputes and has experience in union engagement, including right of entry, protected and unprotected industrial action, consultation disputes, award and enterprise agreement disputes, union correspondence, employee representative engagement, and tribunal escalation where required.
Johan also provides practical training across industrial relations management and psychosocial workplace risk, with a focus on helping employers manage legal obligations, workplace issues and people-related risk in a practical and commercially informed way.
Johan’s approach is informed by hands-on experience in human resources and industrial relations management, including employee relations, disciplinary and performance processes, grievances, restructures, consultation, workplace change, policy implementation, and compliance with awards, enterprise agreements and legislation.
